Terms of Service
Please read these terms carefully before using OneAlbum.
1. Introduction
Welcome to OneAlbum, a digital event media platform operated by OneAlbum (referred to as “OneAlbum,” “we,” “us,” or “our”). OneAlbum provides tools and services that enable event hosts, organizers, and attendees to collect, upload, store, and share event photos, videos, and related information through QR codes, web forms, and associated digital experiences (collectively, the “Services”).
By creating an account, accessing, browsing, or using any part of the Services, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Services.
If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity. If you are an individual, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian. References to “you” or “your” mean the individual or entity using the Services.
2. Use of the Services
Subject to compliance with these Terms, OneAlbum grants you a limited, non-exclusive, non-transferable right to access and use the Services for lawful, personal, or organizational purposes related to events and media sharing.
You agree not to:
- Use the Services to develop, offer, or support a competing product or service
- Interfere with, overload, disrupt, or damage the Services, infrastructure, or servers
- Attempt to gain unauthorized access to any part of the Services
- Use the Services in violation of applicable laws, regulations, or these Terms
3. Third-Party Platforms and Integrations
The Services may allow you to connect with or link to third-party platforms (including social media, cloud storage, or messaging services). When you choose to integrate or connect such platforms, you acknowledge that your use of those services is governed solely by their respective terms and policies.
OneAlbum does not control and is not responsible for third-party platforms, nor for any actions you take on those platforms. You authorize OneAlbum to access and interact with connected third-party accounts solely as required to deliver the Services you request.
4. Account Registration
To access certain features, you must create an account and provide accurate, complete, and current information, which may include your name, email address, phone number, billing details, and event-related data.
You agree to keep your account credentials secure and are responsible for all activity conducted through your account. OneAlbum reserves the right to suspend or terminate accounts that contain false, misleading, or incomplete information.
Unless expressly approved by OneAlbum, you may not create multiple accounts for the same individual or organization, nor use automated methods to generate accounts.
5. Privacy
Your privacy matters to us. Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using the Services, you consent to the practices described in that policy, which forms part of these Terms.
6. User Content
You retain ownership of all photos, videos, text, and other materials you upload or submit through the Services (“User Content”). You confirm that you own, or have the necessary rights and permissions to use and share, all User Content.
You agree not to upload or share content that:
- Is unlawful, misleading, defamatory, obscene, or abusive
- Infringes intellectual property or privacy rights
- Promotes hate, discrimination, violence, or illegal activity
- Contains unauthorized advertising or commercial material
- Poses a risk of harm to individuals or property
You are solely responsible for your User Content. OneAlbum does not actively monitor content but reserves the right to remove, restrict, or disable access to any content that violates these Terms or applicable law.
By uploading User Content, you grant OneAlbum a worldwide, non-exclusive, royalty-free license to host, store, process, and display such content solely for the purpose of operating and improving the Services.
7. Fees and Payments
Some features of the Services may require payment. Applicable fees, billing cycles, and pricing details will be presented at the point of purchase or on our website.
OneAlbum may modify pricing or introduce new paid features in the future, subject to reasonable notice. Failure to pay applicable fees may result in suspension or termination of access to paid features.
8. Third-Party Infrastructure
OneAlbum relies on third-party hosting, storage, and infrastructure providers to operate the Services. We are not responsible for outages, interruptions, data loss, or service failures caused by such third-party providers.
To the maximum extent permitted by law, OneAlbum shall not be liable for losses arising from external service disruptions.
9. Intellectual Property
All rights, title, and interest in the Services—including software, designs, trademarks, logos, and underlying technology—remain the exclusive property of OneAlbum or its licensors. Nothing in these Terms grants you ownership rights in the Services.
10. Disclaimers
The Services are provided “as is” and “as available.” Your use of the Services is at your own risk.
To the fullest extent permitted by law, OneAlbum disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Services.
11. Limitation of Liability
To the maximum extent permitted by law:
- OneAlbum shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities
- OneAlbum’s total liability for any claim arising from the Services shall not exceed the total fees paid by you to OneAlbum in the twelve (12) months preceding the event giving rise to the claim
If no fees were paid, OneAlbum shall have no monetary liability. Your sole remedy is to discontinue use of the Services.
12. Suspension and Termination
OneAlbum may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services (in whole or in part).
Upon termination, your right to use the Services will immediately cease.
13. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Services or communicated to you. Continued use of the Services after such changes take effect constitutes acceptance of the revised Terms.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by OneAlbum, constitute the entire agreement between you and OneAlbum regarding the Services.
15. Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent from OneAlbum. OneAlbum may assign its rights or obligations at any time.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles.
